Freeholder's Bloodwork Results Come Back Negative, State Police Say

Alcohol and drug tests done on Freeholder John P. Kelly following a May 18 accident that killed a Barnegat motorcyclist have come back "clean," State Trooper Christopher Kay said.
"It was negative for any type of alcohol or drugs," he said.
The investigation into the accident that took the life of William D. Kolb will probably be completed within the next several weeks," Kaye said.
"It's in the final stages," he said. "The detectives have to make sure they cross their T's and dot their I's. Then they will submit the final report."
Once the report is submitted, State Police detectives and the Ocean County Prosecutor's Office will decide whether any summonses will be issued, Kaye said.
State Police had previously said it could take six to 8 weeks for toxicological tests to be completed. Kelly consented to the procedure, which is standard protocol in fatal accidents, state police have said.
Kolb, 24, was thrown from his motorcycle after it collided with the SUV driven by Kelly, state police have said.
Trooper Joseph Mezzo has said that Kolb was southbound on Route 9 on his black 2011 Harley Davidson at approximately 6:35 p.m. on May 18, near mile marker 65.5. Kolb attempted to pass the vehicle in front of him, then collided with the right fender of Kelly's 2005 SUV when he tried to return to the lane of traffic, he said.
Kelly, 61, West Creek, was northbound on Route 9 and was attempting to make a left turn into the West Creek Deli when the collision occurred, Mezzo said.
Kelly previously described the accident as "traumatic."

Everybody is so quick to believe the worst just because someone is well known. I do t know him, but I do know a "nobody" that was involved in a fatal (it's mandatory that blood is taken) and it took almost two months as well. People need to stop starting rumors and focus on worrying about the families of those involved. It's a tragedy for both sides.

I don't think most people are aware of just how much work goes into a fatal accident investigation. These things can take months to fully complete, the final case file several inches thick. The cops don't just walk onto the scene & say "oh look, that's what happened" . They are specialized units that receive extensive training. The damage to the vehicles are assessed, photos are taken, evidence is collected, skid marks are measured, lasers are used to measure scenes, mathematical equations are used to determine speed, witness statements are taken at the convenience of the witnesses. Autopsy & toxicology reports take weeks. And they don't generally work only one case at a time. Do some research on the Internet, fatal accident investigation = long, thorough & complicated process, not necessarily cover-up

Accidents happen. I don't think this case was handled any different than any other fatal accident. taking a blood test proves there was no alcohol or drugs involved. I bet all the people that were involved in this accident and their families are all upset. even though kelly was not at fault he will carry the mental burden of this accident the rest of his life. this is why they call it accidents. I am sure the family of the cyclist is very upset and by all rights they should be. they lost a loved one. but because Mr. Kelly is a figurehead he is going through extreme scrutiny which is unnecessary. please think how many times we were almost involved in a serious accident or was in a serious accident. everyone's quality of life has been altered forever. just for the record usually the blood reports are held back to the final report. in this case they were released before the final report. Please let law enforcement do their job.

May 9, 2012, Essex Cty, Judge C.A. Murray announced
that the Essex Cty. Grand Jury indicted A. Nunez 20, for
first-degree aggravated manslaughter, second degree
vehicular homicide, second degree assault + 4th degree
aggravated assault by automobile in the death of Ms. A. Nelson.
Nunez the driver was driving when his auto hit a utility pole
and the young woman-Nelson was thrown from the rear window
suffered severe head and body trauma injuries ... she died.
This was in West Orange, NJ Sept. 2010.
Things take time for the system to work through all the details.
Many are watching the officials. Much to consider in this tragic
incident and the loss of a young man.

The one that should take responsibility for the accident has died. HE tried to PASS on the RIGHT then tried to move back into the lane, there was a witness !

He didn't pass on the right. He made a legal pass on the left. AFTER he had already returned to his lane of travel, Kelly made a left hand turn in front of him. Read the police report before you try to act like you know what happened.

Shaylah... I didn't say he "made" a pass on the right I said he TRIED to pass on the right and couldn't and tried to get back into his lane. Why don't you produce the Police report... that you claim says he made a left turn. If thats true then Lacey patch reported all the wrong info. I'm going by what I read in the Lacey Patch... can't fault me for that.

There was a "witness" that proves nothing. Could someone had been called to get there before the cops did? Happens all the time with truckers and others. How do we know that the "witness" was actually there the whole time and really did see the accident happen? We don't but we will take the story of the "witness" and Kelly as the truth because no one else was there to see it.

My retired deputy chief of police relative told me
(based upon what's been reported/spoken of ... he Kelly was turning
left into on-coming traffic), anyone who does such
a move in any on coming traffic without being sure of
a clear path is guilty of a serious traffic violation. He said
it's highly possible Kelly did not make that observation ...
I cannot understand but am convinced based upon
the immediate report by the state police at the scene
a cover up may be perpetrated ...
he also stated based upon 34-years of police experience
in New Jersey, a traffic violation combined with a mortality
is surely something the family should be making a complaint
at the state government level ...
but does also understand that politics often is complicit.
Kelly the only witness ... wrong, the dynamics of such an accident
show there was a move on the part of Kelly, he did not have a clear
path to make such a move into the biker and any traffic ... bad
driving judgments are made every day in our area ... I see it all the time
with cell phone use and drivers coming straight at me ...
FACTS are FACTS ... any such prefabrication is also a felony.
Young bike drivers are a serious target ... rest in peace
