Ritacco Sues Toms River School Board

Former Superintendent facing trial for bribery, sues school board for unused sick pay and deferred compensation plan

 

Attorneys for former Toms River Schools superintendent Michael Ritacco have filed a lawsuit demanding the school district pay him for unused sick days and his deferred compensation plan.

Each of the current members of the Toms River Regional School Board, as well as three members whose terms expired in 2011 and board attorney Thomas Monahan, are being sued in the federal lawsuit filed Oct. 25. That's four days after the one-year anniversary of Ritacco's federal arrest for bribery and fraud, the same day he resigned as superintendent.

Suing for Unused Sick, Vacation Time and Deferred Compensation

At issue is approximately $63,000 in unused sick and vacation time Ritacco accumulated. Business Administrator Bill Doering said in an interview with Toms River Patch on Oct. 20, before the lawsuit was filed, that there had been no action by the district to pay that money.

The lawsuit also demands the undisclosed amount of money in Ritacco's deferred compensation account, set up by the district as part of his contract.

The plans are called 457 plans, and allowed Ritacco to voluntarily defer some of his $234,000 annual salary into a fund to be used after retirement goes into effect. This allows the district to use that money to invest and earn interest, while it affords the plan-holder the advantages of a reduced taxable income.

The current contract, which would have lasted through 2012, is clear, said Ritacco’s lawyers. At issue are two things Ritacco is due, they said: all moneys put in deferred compensation and any unused sick and vacation time.

The lawsuit contends Ritacco is due:

  • $15,000 in unused sick days.
  • $23,750 for 25 unused vacation days from the 2008-09 school year.
  • $24,062.50 for 25 unused vacation days from the 2009-10 school year.
  • An undisclosed amount of money in a deferred compensation fund, in place since 2010. Ritacco is asking for the money as a lump sum, although his contract would also allow for regular payments.

Ritacco is suing for the money owed in sick and vacation days and in his deferred compensation fund. An he is also suing for compensatory damages, consequential damages, punitive damages, interest, attorneys' fees and the costs of the lawsuit.

Resigned Amid Scandal

Ritacco, who resigned the same day FBI arrested him on charges of bribery allegedly involving the Toms River Regional Schools insurance broker Francis X. Gartland, is entitled to the money in his 457 fund 60 days after his employment ended, said his lawyers, Jerome A. Ballarotto and William J. Hughes. That would have made the money due Feb. 19, 2011, according to the lawsuit.

Ritacco surrendered to authorities in Newark on Oct. 21; he resigned from his superintendent post that same day.

Ritacco's lawyers previously came to a Toms River Board of Education meeting in March to publicly demand the money.

Requests for the Money

The issue had not come up since that meeting, said board attorney Thomas Monahan, who told Toms River Patch after last month's school board meeting that no action had been taken by the board on the money, nor had Ritacco's lawyers communicated with the district about it.

"There hasn't been a phone call, a letter, no discussion on it since that spring board meeting appearance — nothing," said Monahan.

But later that month, Ritacco's attorney, William J. Hughes Jr. filed the lawsuit on grounds Ritacco's civil rights are being denied, by the district failing to release the moneys due under his contract.

The lawsuit says Ritacco and his counsel first asked for a payout of the funds on Dec. 20, 2010, and have asked numerous times since then, and were denied after the board consulted with a tax attorney — unnamed in the lawsuit — but that the tax attorney was not one licensed to practice in New Jersey.

Denial for 'Political' Reasons

Current school board members were served with the summons of the lawsuit this week, sources said, with Ben Giovine, Loreeen Torrone, Alex Pavliv, Ed Gearity, Gus Kakavas, Jamie Jubert, Tom Baxter and Mike Jedziniiak each named as defendants. Former school board members Linda Garvey, Betty Vasil and Meera Malik, whose terms ended in April 2011, where also named as defendants, as is board attorney Monahan.

Ritacco served as superintendent for 20 years, and was employed for 40 years in the district. His most recent contract was approved by the board in 2007. The deferred compensation fun was created in 2000, according to the lawsuit.

The lawsuit states the district has not released the money due to a provision called "substantial risk of forfeiture" that it has misinterpreted based on the faulty advice of a third-party tax attorney the district consulted. The lawsuit also accuses the school board of not releasing the money due to solely political motivations.

""The true basis for the board's action is purely political, and has little or no basis in law or in fact," states the lawsuit. "...it is alleged that the board...denied Ritacco his 457(f) plan benefits and sick and vacation time as a result of a political motivation, finding that it would be 'political suicide' for the board to release these funds to Ritacco."

Ritacco has pled not guilty to all charges in the 27-count indictment and remains free after posting $1 million bail. He is awaiting trial April 3.

"Ritacco has pled NOT GUILTY, and has, and will continue to vigorously fight these charges," states the lawsuit.

The 27-count indictment against Ritacco contains two counts charging separate conspiracies to defraud the IRS and seven counts of making and subscribing to false federal personal income tax returns. The charges include the tax years of 2004 through 2006 for Ritacco and 2004 through 2007 for Gartland. More than $1 million in bribery payments are alleged to have been made to Ritacco or intermediaries in exchange for influencing contracts, according to the criminal indictment.

U.S. Superior Court Judge Joel A. Pisano is presiding over the civil case, and was also recently reassigned to hear the criminal case.

Ritacco is a thief! Rat! He has strong armed many to get what he wanted. Now he is going to pay for his greedy ways. Can't wait to read the story here when he is carted off to Federal prison. As for his money... If he is Owed $, place it in an account that is untouchable by him. And he only receives it if he is proven innocent , but let's face it the FBI has done their homework and they enough on him to place this thief in a room with Bernie.

He breached his contract, so the contract's provisions for all that extra money is void. If TR paid him now, he'd have to pay it back when he's convicted (and he's not going to pay it back from a jail cell). The trial can't come soon enough -- Put Rat in a cage!

The town suing Him, the prosecutors office involved with the FBI, IRS suing and pursuing his illegal gotten funds and tax evasion...If you give him this money that is from a poisoned tree , you will NEVER get it back, or will be tied up years in court...Don't fall for his Lawyers maneuvers , they want MORE monies up front as his earnings are NILL....& NO one is calling him to work for them ! The Second Coming of Ritacco will not happen. Also, How do you like that sign on the Pine Belt Arena? Stop giving a school district such a bad name.

We need to weed out the rest of the crooks in Toms River, especially the ones on the Planning and Zoning Board that give building contracts to their buddies, so no one prospers but them; meanwhile the entire area is being over run with strip malls and square box construction. And don't even get me started on those variances to build huge homes on undersized lots. Dirty Politics in T.T. ALL ABOUT $$$$!

First, Ritacco is NOT GUILTY by the standards of the law...only the opinion of much of the public. He has a right to his monies legally! The Board, by public demand, ILLEGALLY withheld his monies. Until proven guilty, he should have received his unused sick and vacation pay. The BOE is responsible for making prudent fiduciary decisions on the advise of counsel. Of course that said, Monahan enters the picture. Now if I was a conspiracy theorist, I might think this was created to be just another pay day for Gilmore and Monahan. They are / were buddies right? Did MJ RIT, Mike, build Monahan's house in 2006... I think? I would love to know the reasoning by Mr. Monahan when advising the BOE to withhold these funds. So if they serve the board members with intent to sue, will past BOE members Vasil, Garvey, and Malik also be served? The decision to withhold Mike's money was made before the new BOE members were elected. I also believe there is new legislation protecting board members from suit. It is the BOE members oath of responsibility to protect the taxpayers and thereby serving our children! My question is should / can Monahan be fired if Mike wins this one? But Mike may not win the next one! Too much money being spent on lawsuits in this district!...irresponsible law suits maybe created by the incompetence of the Board!

To Mr ? (You realize how suspicious THAT is, right?)
Ritacco is indeed innocent until proven guilty. True enough, as we stick to the letter of the law and the rights we all have under those laws. Now, I'm not a lawyer, and neither are you, most likely -- HOWEVER, until he is exonerated of all charges (any of which would release the BOE from honoring any contract between them and Ritacco), there's no reason he should be awarded any coming pay, pensions, sick time or whatever. Once he's declared Innocent, that is another matter. (And frankly, That's not going to happen).
I'm sure the decision to withhold his money was made IMMEDIATELY upon his official arrest, which came within 24 hrs of his "resignation". Questionable but very convenient timing, that resignation, if you ask me...
The BOE is an entity on it's own, not individuals who may or may not have ties or allegiances to Ritacco or anyone else.
As a Board they are to do what's right and legal while serving the SCHOOL district, not any individuals who want more $$ in their own pockets while awaiting trial.

Pay the creep. Then attach the payment to a lawsuit seeking to recover the millions he cost the taxpayers in his willful, greedy deceptions. I cracked up when I saw Monahan's name on the list of people being sued. Did Tommy and Taco have a falling out after working so closely together for so many, many years? Or did Georigie boy turn him down for a loan? Maybe Taco is starting to feel as if he got sacrificed like Van Pelt. Van Pelt didn’t squeal, but he didn’t know as much as Taco. Corzine may represent a lot of failures, but Christie's behavior is the failure here. Taco and Georgie were both advance men for Governor Christie's transition team, and Taco was tapped to be Education Commissioner. I doubt he would have messed up the paperwork for the federal school money, or would have covered up Christie’s blunder better, but it probably doesn’t matter much. I don’t think we would have seen a lot of that money anyway. Some habits die harder than others. And please don't refer to Taco as Bernie Madoff. As low as Bernie may be, Taco couldn't stand tall enough to even sniff Bernie's shoes.

I wonder if we would have had all of these lawsuits if Mikey the Rat had be suspended by the BOE after the FBI and IRS raided his home way back in April of 2010. But, then again the people who were seated on the BOE at that time couldn't and didn't do that to him way back when because he OWNED ALL OF them! The way that I see it they all turned a blind eye to what he was up to and what the IRS and FBI said that he was involved in because he gave their family members job in the district.

"The BOE is an entity on it's own, not individuals who may or may not have ties or allegiances to Ritacco or anyone else" Allegiances? the board is an entity on its own? That's the way its supposed to be, but so many think different and said Ritacco was in charge.
"As a Board they are to do what's right and legal" Key word - LEGAL, and the word RIGHT (what should be done) are two different things!! " The withholding of his 457 was given with the advise of tax attorneys form PA, which the APP also stated as not being licensed to practice / give legalize in NJ. Should Monahan have known that, ( being out of state and not licensed here) when he deferred to those attorneys, when he stated he was not versed in that law? As for Ritacco's contract and his right to his unused vaca and sick day money, that is governed by state statute...the law. And as I said, I would love to know the legal basis by which he advised the BOE to withhold that portion of the money. And please, don't think I am defending Ritacco as I think he is guilty since the Feds usually don't make mistakes

M ? - My comment about being suspicious was in reference to your name; "Mr ?".
I did not remember seeing it on this board anywhere before.... So I assumed you were really "new" to the forums and perhaps hesitant to reveal your identity. I've since discovered that while we have not come across each other until now, that you've been around for a while. Sorry for the assumption.
As for the BOE being an entity in itself- I think I did explain that in my next sentence or two when I said:
"The BOE is an entity on it's own, not individuals who may or may not have ties or allegiances to Ritacco or anyone else. As a Board, they are to do what's right and legal while serving the SCHOOL district, not any individuals who want more $$ in their own pockets while awaiting trial."
Meaning that they are there to protect the interests of and contracts with the SCHOOL - first and foremost, not necessarily Ritacco - or any individual - who may or may not be "pulling their strings". I don't think it's so unusual for lawyers outside one's state to be consulted on matters like this, because it's hard sometimes to find lawyers in your own area/county/state who are not in some way "connected" to people involved. These PA lawyers were consulted, not actually brought in to represent anyone. I don't see a problem there. Lastly, I feel Ritacco is only entitled to that $$ if he is found innocent, not if he is guilty. So he needs to wait.

That "one can vote every single time they refresh the page or leave and come back to the page" does not appear to be the case. Maybe if you are employing a randomizer or other specific plug-in but what you describe hasn't happened even when I clear the cache. I'll ask our Help Desk but I've yet to experience what you describe.

I've never seen what EggsnToast describes. I also don't believe you can change a vote once you cast it but I did inquire with the Help Desk. This poll actually has fewer votes than many of the others that have been around for a day, so I'm not sure there is widespread re-voting, if that is even possible. I don't believe it is possible but I am checking with Help Desk.

Yes, it is easy to revote if you care too. Mattie, Eggs, no reason to delete your comments. A lot of people vote and don't comment. Personally, I don't know why anyone would want to revote on any of these polls, but going to a lot of trouble to try to fix the problem is pointless. It's just as easy to revote under different handles, I’m sure, or in different Patches that carry to same feeds. Accept these polls for what they are and remember that your vote is the only one that counts anyway. And Mattie, be prepared for a lot of visits from the county GOP before the election. They are always looking for new ways to bolster their election results and this year, Freeholder Joe Vicari needs all the second, third and fourth votes he can get. Fortunately, this year, I don’t even think that will help Vicari get reelected again. Frankly, he has been so well hidden from the public during this campaign that you wouldn’t even know he was running if it wasn’t for the billboard-sized posters blocking numerous intersections throughout the county. I’m looking forward to seeing these signs come down for the last time after the election. It’s definitely the first step in your investment in lower property taxes.

I answered "yes" to the poll only because it sounds like he legally is entitled to it.....Do I agree that he should get it after what he did to this school district? Absolutely not!! When I first read the headline, I said to myself, "What a scum* he's got to be kidding after all the money he took from us". Legally, I just don't know the law well enough. My family and I saw him eating breakfast at the Rainbow Diner a few months ago. He should be in hiding. He's certainly got nerve!

"As a Board, they are to do what's right and legal while serving the SCHOOL district" Again, do you believe that is what has happened in this district? "not any individuals who want more $$ in their own pockets while awaiting trial." Wow!! Maybe not only regards this lawsuit, but past history with the nepotism, cronyism, special and conflict of interest, known to be rampant plague in this district, my comment about the " Gilmore / Monahan payday" could be believable. That statement was made before I found out Monahan was also served, and of course he wouldn't defend himself, but maybe other fat cat pay to play attorneys somewhere in or beholden to the firm might. Oh, and EnT, I am not new to comments on the Patch, I have been here since the Patch first went online. Also I agree, outside legal opinion may be sought as reference, but can it legally be used to support a suit in NJ. Bottom line with this issue is this BOE are deep under rocks and there is no "hard place" This is, and will be a no win for Ritacco, the BOE, the tax payers, and especially the children...what a shame!...only for the attorneys!

Lawyers become rich on both sides, or later on after recognition and go into private practice , judge ships or politics ...the latter preferred as the public once again supports them. Private can be hit or miss and bust your butt every day, where as in public you can float on your back most days....and still get that pay check no matter what ! When alone in that room at the end of that day the only thing you have left is that good name you got from DAD..and Mike you ruined that too !!!! You can NEVER hold your head high again...such a shame ...on you !! You will go down in history , just not for what you wanted...greed took your soul and marriage

This suit is just a sham to take the spotlight off tomorrow's county election. Freeholder Vicari, a big supporter and buddy of Mike Ritacco, is running for reelection for the umpteenth time. Instead of suing for more taxpayer money to support his habits like Mike, Joe Vicari is hiding in his garage on his grounded golden magic carpet hoping the voters overlook his backroom style of continually enriching himself with devious financial tricks that defy American values and respect. How many voters get to tell their boss they are taking early retirement so they can collect retirement benefits while still working and being paid for the jobs they officially 'on-the-record' retired from, but didn't really retire from in 'real life'? Why then would we support someone that truly believes they are above the rest of us and are entitled to these self-gratifying entitlements? Voting against Joe Vicari as Freeholder in this election is a financial no-brainer. Getting rid of someone like Vicari and Ritacco that have so little personal class is simply a refreshing, personal bonus. Vicari is the poster-child of GRIP, and deservingly so. It's time for Joe to understand what retirement is all about, so let's retire him officially on Nov. 8. It’s the American way.

If Michelle Rosen is the Democrats 3rd or 4th choice, so be it. Joe Vicari represents everything you don't want your children to grow up to be like. He has become nothing more than a public parasite. If Joe ever worked for the people instead of solely for himself and Georgie, its more years ago than I can remember. Maybe Buckelew might remember. No matter what one thinks of Michelle Rosen, she is the only shot the people have of learning if the Ocean County Board of Freeholders holds any meaningful purpose at all, aside from, of course, draining the taxpayers of money to support all the family members born into non-essential county lifetime appointments. Voting Vicari out of office is unquestionably a financial no-brainer. All other no-brainers can be referred to 'Tired of the status quo', a handle that appears to be very misrepresentative of its message.

It's always better to have at least one dog from the other side making sure they get a bite of the pie. It's the only hope the people have of obtaining insight for at least another year as to how the real costs of county government are overtaxing us. Insight, Dude. Insight.

Great come back!!! We are on the same page. I agree that we really need to change the way that things are done in this town and county! But, when you only run the incumbents and then run the leftovers from the 1970's there isn't much to pick from. What really needs to happen is that the residents need to come out to the Council and Freeholders meeting and hold all of their feet to the fire!

Thanks. It's tough to argue with your logic. I never spoke out for Rosen. I just spoke out against the most embarrassing elected official ever to serve in office. And in Ocean County, that's no easy feat. But he'll be with us for the next 30 years or so. Ocean County loves to elect dead people, and with as little as Vicari is capable of doing, who's going to know when he dies? You just push the same button and get the same result. However, nothing is going to change until some group of Democrats form a new Democratic Party in Ocean County. The current one hasn't had capable leadership in many, many years and is far too hopelessly broken to fix. They can start one on the internet, even right here at the Patch. There were a couple of promising candidates running for Assembly in the 9th District. Perhaps they could bone up on county affairs and run as Freeholder candidates next year. The current board has demonstrated for years that anyone can successfully dance through the position. Also, next year is a big election year, so maybe more voters will actually pay attention. There's a first time for everything, except, of course, getting them to go to, or watch on TV, a Council or Freeholder meeting. I hope you had a better voting experience today than I did. 

Money, money, money, and the Dems don't have it! Look at the money spent of signage and mailers by the Repubs especially in Toms River. Most important is look at the issues. Easy to figure, when Brick had a 25% tax increase, so the Dems took over. TR stayed within the 2% cap and so the incumbents stayed. When a party has been in power, the Repubs in TR, you must then look at what, through their governance, they give to and support organized groups of voters. Seniors, veterans, and especially sports leagues always get what they want...just like girls softball. That is a very powerful system that give a large advantage. When you consider that patronage, with no tax issues, and a large political bankroll (supported by "pay to play" lucrative recycled tax payer dollars contracts), you have an automatic win. The Dems, with their two different groups within, and not enjoying the rewards of incumbency ( is that a word?) will never win against that system.

he retired knowing he is caught to save his pension (sneaky move than sudden retiremen)if he gets convicted he should by all rights lose it & make restitution by selling his assets when need be ..he good live on the interest on the money he stole from the tax payers..
