Superstorm Sandy-Substantial Damage Assessment

Toms River seems to be using township tax records to determine the Market Value  of home/structure compared to what they feel was the damages to force citizens to elevate homes since their equation makes homes substantially damaged(>50%). Has anyone challenged this crazy basis?
