Toms River Contractor Accused of Working While Unlicensed, Failing to Finish Jobs

A Toms River contractor is accused of with working on several homes without a license and taking money from clients without finishing jobs, the Ocean County Prosecutor’s Office announced.

Brian Nogiewich, 54, is charged with filing false documentation with the state Office of the Attorney General Division of Consumer Affairs and engaging in home improvement contracts while not a registered contractor in New Jersey, the prosecutor’s office said.

It is alleged that Nogiewich was not registered between the dates of April 28, 2012 and October 22, 2012, when he engaged in contracts with several individuals to complete work on their homes, according to the prosecutor’s office.

It is also alleged that Nogiewich received payment from victims and either did not start work or did not complete work on their homes.

Nogiewich then falsified his home improvement contractor application for initial registration with the state Attorney General Division of Consumer Affairs, the prosecutor’s office charged.

Nogiewich was arrested at his Toms River home and charged him with third degree theft by deception, third degree tampering with public records and fourth degree unregistered home improvement contracting. He is free on $25,000 bail with no 10 percent option set by Superior Court Judge Wendel Daniels, according to the prosecutor’s office.

Authorities ask that anyone who has utilized Nogiewich for work or has information about him should contact prosecutor’s office Detective Lindsay Llauget at 732-929-2027, ext. 3462.

Nogiewich has faced similar charges before in New Jersey, according to an NJ.com article published in 2008

The Ocean County Department of Consumer Affairs and the Toms River Police Department provided assistance with the investigation, the prosecutor’s office said.
