Fines, increased inspections required for big box retailer
Kmarts in Brick and Toms River were found to have sold or offered for sale expired infant formula and non-prescription medications, officials say. As part of the discovery, Kmart will pay $302,500, donate $25,000 worth of infant formula to charity, pay for continued unannounced state inspections, and implement new product inspection measures as part of a settlement with the state Division of Consumer Affairs, officials announced Friday. The big box store company has been found to have sold, or offered for sale, at least 10 expired items at the Brick store on Route 88, and seven items at the Toms River store on Route 37, court documents say. Nineteen New Jersey Kmart stores carried expired baby formula and non-prescription medication, according to the Attorney General's Office.
Kmart will pay $302,500, donate $25,000 worth of infant formula to charity, pay for continued unannounced state inspections, and implement new product inspection measures as part of a settlement with the state Division of Consumer Affairs, officials announced Friday. Sears Holding to close one store in New Jersey
The company that owns the Sears store and the K-Mart in Toms River announced on Feb. 23 the closing of more stores throughout the country, but none of the Toms River sites are affected. In December Sears Holding announced that more than 100 stores would be closed in the future. At that time neither of the Toms River locations was included in the list. Of the 15 added to the list of store closures, only the Kmart on Route 206 in Hillsborough came from the garden state. No stores in the state were part of the first and much longer list of closures released in December were located in New Jersey. 100 to 120 Kmart and Sears stores could be closed across the country

With the announcement last week that the company that owns Sears and Kmart plans to close more than 100 stores, the two businesses in Toms River are not on the current list of stores announced to close. Sears Holding says more stores will be added to the list, but had no defined timetable to do so, according to a company statement this week. The closing list is currently 80 stores long, with Sears Holding announcing as many as 120 Kmart and Sears stores could close. In Toms River, Kmart is the anchor store to the plaza bearing its name on Route 37 East, after the Hooper Avenue intersection. 23 year-old female discovered Wednesday morning
Police discovered a 23-year-old woman dead in a vehicle parked at the Kmart plaza on Route 37 last Wednesday morning, in an incident police said is still under investigation. No foul play is suspected at this time, said Toms River Police Chief Michael Mastronardy, who did not give out the victim’s name. The Bayonne resident was found in her 1990 Dodge in the large parking lot of the major plaza. The woman was discovered around 8:30 a.m. last Wednesday, Aug. 10, said the police chief. “She was DOA. We believe she drove to the lot Tuesday night or early Wednesday and died there,” he said. Mastronardy said yesterday autopsy results were not available. Suspect allegedly searched for unlocked cars in K-Mart plaza
Police arrested a man who allegedly roamed the K-Mart shopping plaza looking for cars left unlocked, after a witness called police Wednesday afternoon. Anthony Serafino, 28, of Walchest Drive in Toms River was arrested 1 p.m. Wednesday on a burglary charge. Toms River Police Chief Michael Mastronardy said a witness contacted police after she saw a man attempting to open doors of vehicles parked in the K-Mart shopping plaza on Route 37 eastbound. Mastronardy said the suspect broke into one vehicle in the parking lot, and police arrived to investigate. While the stores are ultimately responsible, the mistake they make is counting on outside sales/service organization often referred to as 'brokers' to rotate and pull products that are close too or out of date.
